im so sorry for your loss John..hopefully if things work out you can still use AT LEAST the powertrain...part it out and junk the shell..thats the only way to go at this point

and people wonder why i ALWAYS put insurance on all of my vehicles wether im driving them for a week or a couple of years...and uninsured motorist is a must in our neighborhood

Yes Johns car is here... I will wait for him to find a car to use the entire drive train in... Most everything he put into the car will be reusable if he finds another H body for cheap... One with a Blown Engine or trans will be the way to go...

So today I've found out that the official police report states that they were unable to determine fault, and in that, being the only party with insurance, I'm partially now liable for the accident, on top of being out for all costs personally incurred, in addition to pain incurred to my passenger and I.

WTF?!?!? So because you were responsible and had insurance, you're now partially liable for the accident?!? I'd talk to a lawyer or something to see about getting that off your driving record. That's going to spike your rates higher for years. And the other guy is getting off scot-free. That's fishy as heck.

This essentially means the other party, though at fault, can now sue for their "pain and suffering" as well as a total loss of their vehicle.

John, I'd seriously consult an attorney who deals with insurance fraud. I know who your carrier is (same as mine), and they are BY LAW, required to tell you that by not putting uninsured motorist in your binder, you are subject to (x, y, and z) should an accident occur. In fact, there should be a signature page stating you turned that down if it was offered. If no such page exists, you have a winable case on your hands.

Lawyer up, and SUE. Sue NOW, sue FIRST, and sue for the full value of the car, PLUS Matt's glasses and whatever other injuries or damaged/destroyed property you had in the car.

In some states, you can file an objection to a police report, and ask for a review. Find out, and if you can, DO it. I wish like hell I had seen this thread the day that happened. I'd have told you to check with all those businesses around to see if they had cameras that might cover any part of the intersection.

IL requires it also..i dont care if they do or not..i put that *shoot* on there for this very reason
