i would think that if you gave them the keys that they are responsible. especially if they were careless enough to just leave them on the counter. work order or not the car was in their possession and they had your keys. you would think that they would have some sort of insurance in case something happens to a customers car.....

hope you get it back in the same shape you left it

I would think so. You need to talk to a lawyer though.

You've got to be kidding! Of course they are responsible. You left the keys with them and they admitted to taking them. What they do with them after that is their liability. You have the proof in the police report. You have the right to sue them for the worth of the car. If they are a legit business they have to have insurance!

You need to talk to the "owner" of the shop and show him the police report.

Doesn't matter if they say they have a work order or not, because a judge will look at the party and think "Perhaps they destroyed the WO when they realized they screwed up".

I'd say look them up under the BBB and see what other dirt they have on them. I'd also contact all the the news and radio stations and see which one will pick up the story. The shop won't like any of the negative publicity and hopefully settle up with you.

If you have to sue, sue for the used, excellent condition with approximate miles, and list all the options. Bring any appraisals you pull up, and average them all together.

I will try and do what you said about contacting the news/radio station and see who will help me because your right about them not liking the negative publicity.

The thing is they were the ones who contacted to police not me and im sure they knew the detective that came and made the report. im sure they do. Anyways, after making the report, i went back to the police car and told the detective to make sure that he adds in the report that the employee admitted in takeing my keys and setting them on the counter.

I hope he is not a dirty cop. Im suppose to pick up the police report this monday or tuesday. If the report says that he admits in getting the keys from me, then thats all i want to see. I know 99% its an inside job becaus right when i started telling them that i will sue them, they started saying "you dont have a work order" as if they already planned it.
